Why Nuclear Verdicts Keep Getting Bigger — And What Fleets Can Do

A "nuclear verdict" is any jury award over $10 million, and in commercial trucking they have become alarmingly routine. Over the last decade the average size of the largest verdicts has climbed faster than inflation, insurance capacity, and freight rates combined. For a mid-sized fleet, a single catastrophic loss can now exceed the value of the entire company.

The mechanics are not random. Plaintiff firms invest heavily up front — accident reconstruction, jury consultants, and a narrative designed to make the carrier look reckless rather than unlucky. The "reptile theory" coaches jurors to see a verdict as a way to protect their own community from a dangerous defendant. Once that framing lands, the dollar figure becomes almost secondary.

Defensible operators break the cycle before the crash ever happens. Clean, consistent documentation of hiring, training, and maintenance is the single biggest factor in how a claim is valued. A driver qualification file with gaps is an invitation; one that shows a disciplined safety culture forces the other side to settle on very different terms.

The second lever is telematics. Carriers that can produce hard data — speed, following distance, hours-of-service compliance — at the moment of an incident control the story instead of reacting to it. We have watched the same accident produce wildly different outcomes depending on whether the carrier could show the jury what actually happened.
